This website is owned and operated by Frida's II, Inc. This page outlining the Terms and Conditions sets forth the terms of use for our website and services offered herein. This website offers access to our online ordering systems during regular business hours and access to information relevant to our business activities. Through accessing and usage of our website and our online ordering services, you approve and affirm that you have read and agree to abide by our terms and conditions outlined here, and are also legally bound by them. 

To access our online ordering services you must be at least 18 years old, or at the legal age of majority in your local jurisdiction, at the time the order is placed, and possess the legal authority, right, and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website or access our services if any statute or legality in your local jurisdiction prohibits you from doing so. 

Laws and Dispute Resolution: 

These Terms and Conditions, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or the services, shall be governed by, construed under, and enforced in all respects solely and exclusively with the internal substantive laws and regulations of the United States, Washington State, and the local municipality of Anacortes. Any and all such claims and disputes that are not able to be rectified between management and the party making such claims or disputes shall be brought in, and you hereby consent to them being decided exclusively of the relevant legal jurisdiction located in Anacortes, Washington. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded. 

When you order using our online ordering platform, you agree that: 

(1) you are responsible for reading and understanding the full terms and conditions of use of our website and services; (2) you are responsible for reading and understanding the full item description of what you are ordering before you make the commitment to purchase; (3) you enter into a legally binding contract to purchase our items when you commit to placing, and online order and complete the online payment check-out process; (4) you agree to indemnify and hold Frida's II, Inc. harmless from any demands, loss, liability, claims or expenses, including attorney's fees, made against them by any third party due to, or arising out of, or in connection with your use of the website or online ordering system, or any service offered on the website. 

The prices that we charge for our menu items are listed on both our menu page and our online ordering platform. Management reserves the right to change displayed prices for our dishes at any time and to correct inadvertent pricing errors that may occur. All menu items are subject to local and state sales taxes. 

Refund Policy: 

Failure to pick up online orders at no fault of Frida's II, Inc. does not constitute the right to a refund. Customers who place an online order through our online ordering platform are subject to the terms and conditions outlined herein. The customer is responsible to come and pick up their online order in a timely fashion. 

Customers that receive orders that contain errors or mistakes may receive a refund or choose to have their dish remade correctly if Frida's II, Inc. management is notified immediately. Customers who fail to notify management of order issues it mistakes within the same business day of the purchase forfeit the right to a refund. Erroneous dishes must be brought back to the establishment, or clear photographic evidence of the error must be sent in to verify the problem. Management reserves all rights. 

When we receive a valid claim and determine the error is on ours we will begin the refund process or remake the erroneous dish. If we are unable to fix the erroneous dish in a reasonable timeframe, the customer is entitled to a full or partial refund up to the amount of the erroneous dish. Allow 3-5 business days for refunds to fully process and for funds to appear on your bank statement. 

Frida's II, Inc reserves the right to change, with or without notice, prices, and items offered on our menu and online ordering platform. We may permanently or temporarily suspend all online ordering services or suspend access to our services at any time, for any reason, or no reason at all, at full discretion of management. 

Property and Copyrights: 

The Services offered and all materials therein or transferred thereby, without limitation, images, text, graphics, logos, trademarks, copyrights, photographs, audio, and video and all Intellectual Property Related thereto, are the exclusive property of Frida's II, Inc. Except as explicitly provided herein, nothing in these Terms and Conditions shall be deemed to create a license in or under any Intellectual Property Rights, and you agree to not sell, license, rent, distribute, copy, reproduce, transmit, publicly display, publish, adapt, edit or create derivative works thereof. 

Our Right to Suspend or Cancel User's Account: 

Frida's II, Inc. reserves the right to permanently or temporarily remove or prohibit access to our services without notice and liability for any reason, including if our sole determination you violate any provision of these terms or any applicable law or regulation of the United States, Washington State, or our local jurisdiction. You have the right to discontinue use or cancel your member account with us at any time. 

Your Rights Pertaining to Promotions and Notifications: 

By ordering through our online ordering system or signing up for our newsletter you agree to receive from time to time: promotional emails, text messages, physical mail, or other offers from Frida's II, Inc. If you no longer wish to receive such promotional notifications or materials, notify us at any time to opt out or unsubscribe.
